Nomi Terms of Service

1. Who these Terms are between

Nomi is an app made by Pippa LLC and part of the Pippa LLC app family. These are the App Family Terms of Service written for Nomi alone. If anything here differs from the App Family Terms, the App Family Terms apply.

These Terms are a contract between Pippa LLC ("we") and:

• Adults (18 and over): you, for yourself.
• Teens 13 to 17: your parent or legal guardian, who agrees for themselves and on your behalf. You also confirm that you want to use the app.
• Children under 13 may not use the app.

By agreeing, you confirm that the date of birth you gave is accurate and, if you are agreeing for a teen, that you are their parent or legal guardian.

2. What Nomi is, and is not

Nomi is a personal record-keeping and communication tool: it helps you keep notes about meals, drinks and what makes eating easier or harder and, if you choose, share that record with your care team.

Nomi is not a medical device. It does not give medical advice, diagnose, recommend doses, interpret readings or results, or replace care from qualified professionals. Nomi does not diagnose nutrition problems, set food or fluid amounts, or replace help from a clinician. Label values from a barcode lookup are shown as printed and may be wrong. Decisions about your health belong with you and your care team.

3. AI features

Nomi uses artificial intelligence in one feature: photo naming (off until you turn it on). Nomi has no AI chat. You agree that:

• AI output can be wrong. Do not rely on it for health decisions.
• Content you send to AI features is processed by our AI provider only to answer, as described in the Privacy Policy, and is not used to train AI models.

4. Your content

You own what you log. You give Pippa LLC a limited, non-exclusive, revocable license to store, process and show it only to run the app: showing it to you, answering the AI features you use, and sharing it with a care team after you connect and agree. We do not use your content for advertising or to train AI models. Please keep people's faces out of meal photos. The license ends when the content is deleted, subject to section 9.

5. Privacy

The Nomi Privacy Policy and the Consumer Health Data Privacy Policy explain what we collect and why. We never sell your data, show ads, or put advertising or analytics tools in the app.

6. Care teams are independent

Clinics, programs and clinicians you connect with are independent providers, not Pippa LLC employees or agents. We do not practice medicine or supervise your care, and we are not responsible for your care team's professional decisions. A care team sees your record only after you connect and sign a data-sharing agreement, which you can end at any time in the app.

7. Pro subscriptions

Nomi is free to use. Logging, asking for help, your care team, your history and export never depend on a plan or a payment. Nomi offers an optional Pro subscription that adds extras, such as more looks for your companion, bought through the App Store or Google Play.

• Auto-renewal: Pro renews automatically (weekly, monthly or yearly, at the price shown when you buy) until you cancel. Cancel at least 24 hours before the end of the current period to avoid the next charge.
• Billing and refunds are handled by Apple or Google under their terms. Cancel in your device's subscription settings. Deleting the app or your account does not by itself cancel a subscription.
• Price changes apply only to renewals after notice, and you can cancel before they take effect.
• If a clinic or program covers you, you are not offered Pro and are not charged by us.

8. Acceptable use

Keep your sign-in secure. Do not misuse the app: no unauthorized access, scraping, reverse engineering, unlawful content, using someone else's account, or trying to make the AI produce harmful content. Our Acceptable Use Policy applies to the app family too and is part of these Terms.

9. Deleting your account

You can delete your account at any time (see Delete your account). It is closed right away, any connected care team loses access, and your data on our servers is erased within 30 days. We keep records of data-sharing agreements, the deletion itself and any audit records of care-team access for about six years, as the law requires, against an internal identifier rather than your name or email.

10. Parent and guardian rights

A consenting parent or guardian may at any time review what we have collected about their teen, withdraw consent, and direct deletion of the teen's information (which closes the account), by emailing pippa.app.general@gmail.com.

11. Disclaimer of warranties

NOMI, INCLUDING ALL AI-GENERATED CONTENT, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR UNINTERRUPTED AVAILABILITY, TO THE EXTENT THE LAW ALLOWS.

12. Limitation of liability

TO THE MAXIMUM EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT THE APP IS LIMITED TO THE GREATER OF (A) WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $100, AND WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES. THESE LIMITS DO NOT APPLY TO GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR LIABILITY THAT CANNOT BE LIMITED BY LAW.

13. Indemnification

The adult who agrees to these Terms will indemnify Pippa LLC against claims arising from their breach of these Terms, from misstating age, identity or authority, or from misuse of the account they set up or authorized.

14. Arbitration and class waiver

Disputes are resolved by binding individual arbitration under the AAA Consumer Arbitration Rules, not in court, except small-claims matters and where the law does not allow it. No class actions. A parent or guardian agrees to this for themselves and on behalf of their teen. You may opt out of arbitration within 30 days of agreeing by emailing pippa.app.general@gmail.com.

15. Changes and ending

We may update these Terms. For a material change we will tell you in the app and ask you to agree again before you keep using the app. You may stop using the app at any time. Sections 2 to 4, 6, 9 and 11 to 16 survive termination.

16. General

If part of these Terms is unenforceable, it is limited as little as needed and the rest stands. These Terms (with the App Family Terms they follow), the Privacy Policy, the Consumer Health Data Privacy Policy and any data-sharing agreement you sign are the whole agreement about Nomi. You may not transfer your account. Apple and Google are not parties to these Terms and are not responsible for the app, but Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
